Gamvt Buyer Purchase Terms

Terms that apply when purchasing original physical artwork through Gamvt

1. Agreement and Eligibility

These Buyer Purchase Terms (the "Buyer Terms") are between you and Gamvt LLC for use of Gamvt's purchase and order-support services. By affirmatively accepting them immediately before payment, you also agree to the current Marketplace Terms of Use, Shipping and Delivery Policy, and Returns, Refunds, Cancellation, and Damage Policy.

You must be at least 18 years old and legally able to contract. Provide accurate account, payment, contact, and shipping information and keep your credentials secure.

2. Artist Is the Seller

The artist identified on the listing is the independent seller and owner of the artwork. Gamvt operates the marketplace and provides payment-facilitation, communication, order-support, refund-administration, and payout-administration services. Gamvt does not create, possess, inspect, package, or ship the artwork. The way your payment is processed does not change this: the artist remains the seller and owner even when a payment is processed through a Gamvt payment account rather than the artist's own.

3. Original Artwork and Listings

Original artwork may show minor differences in color, texture, scale, framing, or appearance because of photography, lighting, and display settings. Review the dimensions, medium, condition, framing, edition status, shipping window, and other listing details before purchasing. Sellers are required to warrant ownership, authenticity, availability, and listing accuracy, but Gamvt cannot independently authenticate every artwork.

4. Orders, Fees, and Payment

Your order is submitted when you authorize payment. The artist is the seller; Gamvt facilitates and administers the payment and may process it through more than one payment structure. The payment structure used for a given order does not change the artist's status as seller and owner or your rights under these Buyer Terms.

Before you authorize payment, Gamvt discloses the amounts that make up your total, which may include:

  • the artwork price;
  • shipping, if separately charged;
  • the Gamvt Buyer Service Fee; and
  • applicable tax, if any.

The Gamvt Buyer Service Fee is a Gamvt marketplace service fee. It is a Gamvt charge, not a government tax, and Gamvt may discount or waive it. The amount shown before payment is the amount authorized.

Applicable sales or use taxes, if any, may be calculated, collected, reported, or remitted by Gamvt, the artist, Stripe, or another appropriate party, as required by applicable law or as configured for the transaction. Some transactions may have no tax collected.

An order may be paused or cancelled for suspected fraud, duplicate sale, listing error, legal restriction, payment failure, account restriction, or inability to fulfill. A confirmation page or email acknowledges the order but does not prevent cancellation or refund where fulfillment is impossible or legally required.

5. Shipping Address

Provide a complete, deliverable address and review it before payment. You are responsible for accurate shipping and destination information, and for loss or added cost caused by an incorrect address, refused delivery, unauthorized rerouting, or failure to collect a shipment, except where prohibited by law. Contact Gamvt immediately if you discover an error; changes are not guaranteed after shipment.

6. Shipping, Delivery, and Risk

Shipment windows and delivery dates are estimates unless expressly guaranteed. The current Shipping and Delivery Policy controls packaging, tracking, delays, risk of loss, carrier claims, and delivery confirmation. At launch, orders are limited to deliverable United States addresses.

7. Delivery Confirmation and Release of Proceeds

You should confirm receipt once the artwork arrives and you have inspected it. Confirming receipt allows Gamvt to release the seller's proceeds and marks your order Delivered. If you neither confirm receipt nor report a problem, Gamvt may treat the order as accepted and automatically release the seller's proceeds approximately fourteen (14) calendar days after the artwork is marked shipped. This automatic release completes the order administratively; it does not mean you confirmed delivery, and it does not by itself waive a claim that remains timely under the Returns, Refunds, Cancellation, and Damage Policy or applicable law. If you have a problem with the order — non-delivery, damage, a wrong item, a material misdescription, or an authenticity or ownership concern — you should report it through Gamvt before the automatic-release deadline so Gamvt can hold the payout and review the issue before funds are released. Reporting a problem pauses the payout for review; it is not, by itself, a refund. Prompt reporting helps preserve evidence and available remedies, and this process does not waive rights that applicable law does not allow Gamvt to limit.

8. Cancellations, Returns, and Refunds

Original artwork is generally final sale after shipment for change of mind. You may request cancellation before shipment, but a pre-shipment cancellation is a request that requires approval from Gamvt and the artist rather than an unconditional right; the order remains valid until the cancellation is approved. Gamvt will ordinarily approve a genuine pre-shipment cancellation and may decline where the artist has already incurred material fulfillment costs. You may also request a remedy for non-delivery, material damage, wrong-item delivery, material misdescription, or a credible authenticity, ownership, or legal-title issue. Readily identifiable damage, wrong-item, or condition issues should be reported within three calendar days after delivery. When a full refund is provided — including for an approved pre-shipment cancellation — it generally returns all amounts you paid for the affected order, including the artwork price, the Gamvt Buyer Service Fee, applicable shipping, and any tax actually collected. The current Returns, Refunds, Cancellation, and Damage Policy provides the details, deadlines, and treatment of partial refunds.

9. Communications and Conduct

Use artist contact and order information only for legitimate transaction purposes. Do not harass users, attempt fraud, submit false or duplicate claims, misuse personal information, interfere with the Service, or move a Gamvt-originated transaction off-platform to defeat fees or marketplace protections.

10. Copyright and Reproduction Rights

Purchasing a physical artwork transfers only ownership of that physical object, subject to applicable law. Copyright, reproduction, display, merchandising, and other intellectual-property rights remain with the artist or other rights holder unless separately transferred in a signed writing.

11. Third-Party Services

Stripe, carriers, insurers, and other third parties may provide payment, identity, shipping, tracking, or related services under their own terms and privacy practices. Gamvt is not responsible for third-party outages or conduct outside its reasonable control.

12. Disclaimers and Limitation of Liability

Gamvt requires seller warranties and may administer remedies, but cannot guarantee every seller, artwork, carrier, or listing. The Service is provided on an "as available" basis to the maximum extent permitted by law.

To the maximum extent permitted by law, Gamvt is not liable for indirect, incidental, special, punitive, or consequential damages. Gamvt's aggregate liability arising from a specific order will not exceed the greater of $100 or the amount you paid for that order, except where prohibited by law or for Gamvt's fraud or intentional misconduct. Nothing limits non-waivable consumer rights.

13. Governing Law and Disputes

Georgia law governs, subject to mandatory consumer protections where you live. Before filing an ordinary claim, contact admin@gamvt.com and allow a reasonable opportunity for resolution. Court proceedings must be brought in or serving Muscogee County, Georgia, unless applicable law requires another forum. Either party may seek immediate relief for fraud, account misuse, intellectual-property violations, or safety.

14. Changes and Electronic Acceptance

Gamvt may update these Buyer Terms prospectively and will request renewed acceptance for material changes when appropriate. Your unchecked-by-default checkbox or equivalent affirmative action, together with Gamvt's retained record, is intended to form an electronic agreement. Order support and questions: admin@gamvt.com.
